The use of the Hilton Accommodation website (www.hiltonaccommodation.co.za), booking services, and physical property (8 Hilton College Rd, Hilton, South Africa) is subject to the following disclaimer. By booking a stay or using this website, you acknowledge and agree to the terms set out below.

1. Website Disclaimer

  • All information on this website, including availability, pricing, descriptions, and images, is provided in good faith.

  • Hilton Accommodation makes no representations or warranties of any kind, express or implied, as to the accuracy, completeness, reliability, or suitability of such information.

  • Use of the website is at the user’s own risk. Hilton Accommodation accepts no liability for technical errors, downtime, data loss, or security breaches.

2. Accommodation Disclaimer

  • All guests and visitors enter and use Hilton Accommodation’s property, facilities, and amenities entirely at their own risk.

  • Hilton Accommodation, its owners, staff, and affiliates are not responsible for any injury, illness, loss, damage, or death sustained by any person, nor for loss, theft, or damage to personal belongings, vehicles, or valuables.

  • This includes but is not limited to:

    • Slips, trips, or falls on the property.

    • Use of kitchens, appliances, furniture, or electrical equipment.

    • Use of outdoor areas, including gardens, parking areas, and communal spaces.

    • Utility interruptions (electricity, water, WiFi, load-shedding).

3. Facilities & Amenities

  • Where facilities such as braai/BBQ areas, swimming pools, fireplaces, or outdoor equipment are available, they are used at the sole risk of the guest.

  • Children must be supervised at all times by a responsible adult.

  • Hilton Accommodation accepts no liability for accidents, injuries, or damages arising from use of these facilities.

4. Third-Party Services

  • Bookings and payments are processed by NightsBridge, a third-party service provider. Hilton Accommodation is not responsible for technical issues, errors, or losses arising from the use of NightsBridge.

  • Any third-party service providers used by Hilton Accommodation (such as internet providers, taxi services, or tour operators) are independent entities. Hilton Accommodation assumes no responsibility for their services.

5. Indemnity

  • By booking and/or staying at Hilton Accommodation, guests agree to indemnify and hold harmless Hilton Accommodation, its owners, employees, and affiliates from any and all claims, actions, damages, losses, or expenses (including legal costs) arising out of:

    • Breach of House Rules or Booking Terms.

    • Misuse of the property or facilities.

    • Any act, omission, or negligence of the guest or their invitees.

6. Force Majeure

  • Hilton Accommodation will not be liable or deemed in breach of contract for any delay, cancellation, or failure to perform its obligations if caused by circumstances beyond its reasonable control.

  • Such circumstances include, but are not limited to, natural disasters, fire, severe weather, strikes, civil unrest, power outages, pandemics, and government restrictions.

7. Travel Insurance

  • Guests are strongly advised to obtain adequate travel, medical, and personal property insurance prior to arrival. Hilton Accommodation does not provide insurance cover for guests.

8. Governing Law

  • This Disclaimer Notice shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts of KwaZulu-Natal, South Africa.
